GENERAL TERMS AND CONDITIONS

These General Terms and Conditions apply to all offers, orders and agreements between Cozy Cott (hereinafter: ‘we’, ‘us’ or ‘our’) and the customer (hereinafter: ‘you’, ‘your’ or “yours”) with regard to the sale of products via www.cozycott.com (the ‘Site’).
Please read these Terms and Conditions carefully before placing an order.

2. APPLICABILITY
These General Terms and Conditions apply to all offers, orders and agreements between Cozy Cott and the customer. By placing an order via our Site, you agree to these General Terms and Conditions.
Deviations from these terms and conditions are only valid if they have been expressly confirmed by us in writing.
3. OFFERS AND PRODUCT INFORMATION
All offers on our Site are without obligation, unless expressly stated otherwise. We reserve the right to change prices, product specifications and availability without prior notice.
We take great care to ensure the accuracy of product information, prices, dimensions and specifications on our Site. Despite this care, typographical errors or outdated information may occur. We reserve the right to correct any errors without prior notice.
All prices listed on this website include 21% VAT, unless otherwise stated.
Images and colours of products may differ from reality due to screen and photography settings.
4. CONCLUSION OF THE AGREEMENT
An agreement is concluded when you place an order via our Site and we have confirmed this order in writing (by email).
We reserve the right to refuse or cancel orders, for example in the event of:
- Incorrect or incomplete information
- Unavailability of products
- Suspicion of fraud or abuse
- Technical or administrative errors in pricing
5. PRICES AND PAYMENT
All prices are in euros (EUR) and include 21% VAT, unless otherwise stated.
The total price of your order, including any shipping costs and other costs, will be clearly displayed before you place your order.
By placing an order, you expressly agree to the price applicable at that time as shown in your shopping basket and order confirmation. Price changes, discounts or promotions that take effect after you have placed your order do not entitle you to a refund, price adjustment or compensation. Each order is processed at the price that was applicable at the time of ordering.
We reserve the right to change prices, discounts and promotions at any time. Current promotions and discounts are valid until the stated end date or while stocks last, unless otherwise stated.
Payment must be made using the payment methods available on our Site. The order will only be processed after payment has been received and verified.
In the event of late payment, we reserve the right to cancel the order.
6. DELIVERY TIME AND SHIPPING
We strive to process and ship orders as quickly as possible. The expected delivery time is stated with the product.
Delivery times are indicative and not binding, unless expressly agreed otherwise. Exceeding the delivery time does not entitle you to compensation or termination of the agreement, unless the delay is unreasonably long.
Shipping costs are calculated based on the shipping address and the weight/volume of the order. These costs are clearly displayed before you place your order.
The risk of loss or damage is transferred to you at the time of delivery. Please check the shipment for visible damage upon receipt. Report any damage immediately to the delivery person and to us via info@cozycott.com.
7. RIGHT OF WITHDRAWAL (CONSUMER)
As a consumer, you have the right to withdraw from the contract within 14 days of receiving the product without giving any reason.
The withdrawal period expires 30 days after the day on which you, or a third party designated by you who is not the carrier, takes physical possession of the product.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of an unambiguous statement by e-mail.
You must return the product to us no later than 30 days after you have informed us of your withdrawal from the contract.
The direct costs of returning the product are at your expense.
You are only liable for any diminished value of the product resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the product.
Exceptions to the right of withdrawal: The right of withdrawal does not apply to:
- Products that are custom-made or clearly personal in nature
- Sealed products that are not suitable for return for health or hygiene reasons and whose seal has been broken after delivery
8. REFUND
If you withdraw from the contract, you will receive a refund of all payments you have made up to that point, including any delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery we offer), without delay and in any case no later than 14 days after we have been notified of your decision to withdraw from the contract.
We may wait with the refund until we have received the product back, or until you have demonstrated that you have returned the product, whichever is earlier.
We will refund you using the same payment method you used for the original transaction, unless you have expressly agreed otherwise.
9. WARRANTY AND CONFORMITY
All products meet the usual requirements and standards that may reasonably be set for them and for which they are intended for normal use in the United Kingdom.
The statutory warranty period for defects is 2 years from the date of delivery for consumers.
Defects must be reported to us in writing as soon as possible, but no later than 2 months after discovery, via info@cozycott.com.
The warranty does not apply to:
- Normal wear and tear
- Damage due to improper or inappropriate use
- Damage due to negligence or careless maintenance
- Damage due to external causes (fire, water, etc.)
- Products that have been modified or repaired by third parties without our consent
10. COMPLAINTS
Complaints about the execution of the agreement must be submitted to us in a timely manner, fully and clearly described, via info@cozycott.com.
We aim to respond to your complaint within 14 days. If a complaint requires a longer processing time, we will respond within 14 days with a confirmation of receipt and an indication of when you can expect a more detailed response.

11. LIABILITY
We are not liable for indirect damage, consequential damage, lost profit, lost savings or damage due to business interruption.
In all cases, our liability is limited to a maximum of the amount of the order or the amount paid out by our insurer in the relevant case.
We are not liable for damage resulting from incorrect or incomplete information provided by you.
12. FORCE MAJEURE
In the event of force majeure, we are not obliged to fulfil any obligation towards you. Force majeure is understood to mean any circumstance beyond our control that prevents us from fulfilling our obligations towards you in whole or in part.
This includes strikes, fire, business interruptions, power failures, disruptions in a (telecommunications) network or connection or communication systems used, and/or failure by suppliers to perform, or to perform on time or properly.
13. INTELLECTUAL PROPERTY
All intellectual property rights relating to the Site and the products offered on it are vested in us or our licensors.
It is not permitted to copy, distribute or use (parts of) the Site, product information, images or other materials in any other way without our prior written consent.
14. PRIVACY AND DATA PROTECTION
We handle your personal data with care. For more information about how we collect, use and protect your data, please refer to our Privacy Policy at www.cozycott.com.
By placing an order, you agree to the processing of your personal data as described in our Privacy Policy.
15. APPLICABLE LAW AND DISPUTES
All agreements between us and you are governed by Dutch law.
Disputes arising from or related to the agreement between us and you will be submitted to the competent court in the district where we are located, unless the law prescribes otherwise.
16. AMENDMENT OF THE TERMS AND CONDITIONS
We reserve the right to amend these General Terms and Conditions. Amendments shall take effect at the time they are published on the Site. We recommend that you consult these terms and conditions regularly.
Agreements concluded before the amendment remain subject to the old terms and conditions, unless the amendment results from a legal obligation.
17. FINAL PROVISIONS
If one or more provisions of these General Terms and Conditions prove to be invalid or are annulled, the remaining provisions of these General Terms and Conditions will remain in full force. We will replace the invalid/annulled provision(s) with new provision(s) that approximate the purpose and meaning of the original provision(s) as closely as possible.
