Terms and conditions

1. Who we are

Cozy Cott.

Chamber of Commerce 74043242. VAT NL859753979B01. Email info@cozycott.com.

These terms apply to consumer orders on this website. Changes are valid only if we confirm them in writing.

2. How a contract is formed

Offers are non-binding. We may change prices, specifications and availability until your order is confirmed.

The contract is formed when we confirm your order by email. We may refuse or cancel an order in case of incorrect data, suspected fraud, obvious pricing or typing errors, or unavailability.

The price in your cart and order confirmation is the price of your order. Later promotions do not create a right to a later discount.

Colours and images may differ because of screens, light and natural wood variation.

3. Products, sizes and assembly

You are responsible for measuring the room, doorways and stairwell before ordering.

A standard choice (natural or white, ladder left or right) is not bespoke manufacturing. Production starts after payment. A free change of ladder side or finish after production has started is not available.

You assemble the bed using the manual. Damage from incorrect assembly is your responsibility unless the manual is demonstrably wrong.

Replacement parts after damage you caused (moving house, use) may be supplied where possible. That is not an open-ended legal duty to restock forever.

4. Payment and VAT

Payment via the methods in checkout. Production starts after payment is received.

Prices are in euro and include VAT as shown at checkout. The VAT rate may differ by country. Older pages mentioning ‘21%’ are not a guarantee for every market.

5. Delivery

Delivery times are estimates, not hard deadlines. For beds, allow about 2 to 4 weeks to the front door, depending on production and transport.

Delivery is to the ground-floor front door. Carrying upstairs is not a carrier obligation.

Because of size and weight, an order may arrive in several parcels, possibly on different days.

We do not deliver to the United Kingdom or Northern Ireland. Some islands cannot be reached. If your country is not in the country selector, we do not deliver there.

Risk passes on delivery. Check the shipment at once for visible damage. Report damage or missing parts as soon as possible, with photos, order number and the part number from the manual, to info@cozycott.com.

6. Cooling-off period

As a consumer you may withdraw within 30 days of receiving the goods, without giving a reason. That is longer than the statutory 14 days.

You first notify withdrawal by email. You then return the product within 30 days of that notice, following our return instructions. Shipments without prior notice will not be processed.

The product must be unused, in the original packaging, with all parts. Direct return costs are yours, unless the item is defective, damaged on delivery or wrongly delivered.

If you use the product beyond what is needed to inspect it (for example full assembly and daily use), we may deduct diminished value.

Mattresses and other sealed hygiene products are excluded from withdrawal once the seal is broken.

True custom work made to your specifications (not the standard options) is excluded from withdrawal where the law allows.

7. Conformity and warranty

Goods must conform to the contract on delivery. Consumers have a two-year legal guarantee. We cannot waive that right.

Report a defect as soon as possible, and at the latest two months after discovering it.

No warranty for normal wear, improper use, careless maintenance, external causes, or modification/repair by third parties without our consent.

We do not limit product liability for death or personal injury caused by a defective product.

8. Liability

We are not liable for indirect loss, consequential loss or lost profit, to the extent the law allows.

Our liability is limited to the amount of the order concerned or to what our insurer pays in that case, except where the law forbids a limitation.

Replies from the site helper chat are informational and are not a contractual promise. Only these terms, the order confirmation and mandatory law apply.

9. Force majeure, complaints, law

In force majeure (including supplier, transport or network failures) we may suspend performance.

Complaints via info@cozycott.com. We reply within 14 days, or acknowledge receipt with a later timescale.

Dutch law. Consumers may often also bring claims in their country of residence. A forum clause does not take away that right.

The EU ODR platform closed on 20 July 2025. We no longer link to it.
